Support for consultation

This $25 million financial assistance budget has been put at the disposal of Aboriginal nations or communities that are planning to participate in the consultation process initiated by the Gouvernement du Québec. The objective of this budget is to facilitate the application of the constitutional obligation incumbent upon the government in this field.

A. Prerequisites

In order to have access to this budget, an Aboriginal nation or community must have been solicited by a government department, a government agency or a government corporation of Québec to have the nation or community take part in a consultation process.

B. Eligible organizations

  • The communities of the Aboriginal nations recognized by the Québec National Assembly
  • Organizations mandated by one or more Aboriginal nations or communities

C. Eligible consultation activities

In order to be eligible, an activity must enable an Aboriginal nation or community to take part in a consultation initiated by the Gouvernement du Québec. The objective of such a consultation must be:

  • to provide relevant information concerning the envisaged action and to allow the Gouvernement du Québec to specify its interests as well as those of Aboriginal and non-Aboriginal populations;
  • to explain, in a precise and clear manner, the nature of the rights of the Aboriginal nations or communities in relation to the envisaged action;
  • to explain precisely and clearly the way in which the envisaged action will have impacts on the rights and interests of the Aboriginal nations or communities;
  • to participate in exchanges with a view to reconciling the rights and interests of the Aboriginal nations or communities with the envisaged government action and to present the possibilities for accommodation, where such is the case.

D. Eligible expenses

The eligible expenses include:

  • the professional fees paid to experts, up to the rates in effect in the Gouvernement du Québec;
  • travel expenses, up to the rates in effect in the Gouvernement du Québec;
  • the expenses incurred to take part in meetings or assemblies;
  • expenses related to the production, preparation, drafting or translation of documents;
  • all other reasonable related expenses that can be linked to the eligible consultation activities.

Eligible expenses do not include the portion of the expenses that are the subject of financial assistance coming from other departments, agencies or mandataries of the Gouvernement du Québec or of the federal government.

Expenses must be incurred during the consultation activities for a maximum period of two years. If the consultation exceeds this period, it will then be possible to submit another application covering a new two-year period.

E. Conditions imposed on the eligible organization

The eligible organization will have to demonstrate the financial needs to be met and submit to the Secrétariat aux affaires autochtones (SAA) the following information:

  • the reason supporting the application for financial assistance as well as the reasonable nature and relevance of resorting to this budget;
  • the plan for carrying out the consultation activities;
  • the place where the consultation activities will be held;
  • the breakdown of the expenses and of the funding of the consultation activities, including the detailed list of the other anticipated sources of funding;
  • the planned steps to participate in the consultation processes;
  • the operating budget forecast and a timetable concerning the consultation.

F. Determining of the financial assistance

The maximum amount of the financial assistance granted, in the form of a non-refundable contribution, will be determined by taking into account the grants paid by other departments and agencies of the governments of Québec and Canada. The maximum financial assistance may not exceed 90% of the eligible expenses related to the consultation activities.

G. Conditions of payment and reporting

All authorized projects will be the subject of a funding agreement between the eligible organization and the Gouvernement du Québec. The consultation activities, the conditions for payment of the financial assistance granted, and the commitments of the parties will have to be clearly defined in the agreement. Moreover, this agreement will provide for a reporting process.
